		<description>The Smithsonian deal is about de facto censorship, not money. Imagine how much chance a  documentarian sympathetic to Scientology or critical of anti-depressants, or heaven forbid! an admirer of Tom Cruise, would have of obtaining material vital to his film from the Smithsonian given that "Mrs. Viacom" is incensed by opinions with which she disagrees.</description>

This reminds me of the whole Smithsonian debacle a couple of months ago wherein they made a secret deal with the Showtime network -effectively making them the sole commercial user of Smithsonian footage in documentary films. In fact, the Smithsonian is predominantly supported by public funds (close to 75%)  making this sellout of national resources for independent documentarians even more infuriating. Below are some links to articles on this development which in many ways reinforces the insidious logic of copyright and ownership you trace above. The shame is that the original artist, The Winstons, essentially gave away the rights to this section of their song and now the copyright is owned by a third-party drum-loop reseller.
